Electronic legal communication (ERV) have become increasingly important in recent years and continues to drive digitalization. It covers the exchange of information between courts and public authorities on the one hand and lawyers, notaries, citizens and companies on the other.
Electronic legal communication (ERV) serves as a secure transmission channel with which it is possible to transfer documents and structural data in court, public prosecutor’s office and other judicial and official proceedings in a legally compliant matter. In particular, the Act on the Promotion of Electronic Legal Transactions with the Courts and other subsequent laws paved the way for digital justice and digital authorities, so that from 2022 – the active obligation to use the special electronic lawyer mailbox beA and special electronic public authority mailbox beBPo has come into effect.

Ensuring the authenticity of the sender and recipient
The requirements laid down by the legislator pose a number of practical challenges. In addition to the confidentiality of the transmitted data, a central challenge is, for example, ensuring that the messages are not falsified and guaranteeing the authenticity of the sender and recipient.
Westernacher Solutions has already developed and established numerous solutions for electronic legal transactions, both in the past and today. These include, in particular, the special electronic lawyer mailbox (beA) and the special notary mailbox (beN).
